Welcome to Face In Face Out (the “Service”). This Terms of Service Agreement (“Agreement”) is a binding agreement between you and Cloud Tool Builder LLC (“we,” “us,” or “our”), governing your use of the Service. By creating an account or using our Service, you agree to comply with and be bound by this Agreement.

1. Definitions

   • Service: The clock-in/clock-out attendance tracking service using face recognition provided by Cloud Tool Builder LLC.
   • User: Any individual using the Service, including Admin Users and Employees.
   • Admin User: A person authorized to create a company account, onboard employees, and manage attendance data.
   • Employee: An individual added to the Service for attendance tracking purposes by an Admin User.
   • Embedding: A mathematical representation of a face used for recognition purposes without storing actual face images.

2. Acceptance of Terms

   By signing up, you confirm that you have read, understood, and accepted this Agreement. If you do not agree, you should not use our Service.

3. Use of Service

   The Service is designed for companies to track employee attendance using face recognition. Admin Users create accounts, add company details, and onboard employees by collecting their names, phone numbers, and facial embeddings for verification purposes.

4. User Responsibilities

   • Admin Users: You must have authorization to provide company and employee information, including sensitive data (e.g., facial embeddings).
   • Employee Data: You must obtain consent from employees to collect their data and ensure it is used solely for attendance tracking.
   • Accuracy: You are responsible for providing accurate information and ensuring that only authorized personnel access the Service.

5. Data Handling

   The Service uses face recognition technology. Only face embeddings are stored, and actual face images are not retained. This data is used solely to enable attendance verification.

6. Prohibited Uses

   Users may not:

   • Reverse engineer, decompile, or disassemble the Service.
   • Use the Service for any unlawful purpose or in a way that breaches any applicable laws.
   • Misuse or improperly distribute employee data collected through the Service.

7. Modifications to Service

   Cloud Tool Builder LLC reserves the right to modify, suspend, or discontinue the Service at any time without prior notice.

8. Limitation of Liability

   To the fullest extent permitted by law, Cloud Tool Builder LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service, including data loss or unauthorized access.

9. Termination

   We reserve the right to suspend or terminate your access to the Service for any reason, including breach of these terms or misuse of the Service.

10. Changes to the Agreement

    Cloud Tool Builder LLC may revise this Agreement from time to time. Continued use of the Service constitutes acceptance of any modified terms.
